Yahoo! Dating Additional Terms of Service
Free Trial - Right to cancellation and refund

If you have signed up for a 7 day free trial subscription you may cancel it, without any penalty or further obligation, before the end of the 7 day period by following the steps outlined under section 7 below.

1. ACCEPTANCE OF YAHOO! TERMS
Welcome to Yahoo! Dating Premium Services ("Premium Services") which is a "Service" as defined in the Yahoo! Terms of Service ("TOS") located at http://au.docs.yahoo.com/info/terms/ . Your use of the Premium Services is subject to these additional terms ("Additional Terms") which supplement the TOS. Your use of Premium Services is also subject to the Yahoo! Dating Guidelines ("Guidelines") located at http://au.personals.yahoo.com/static/content_guidelines.

Yahoo! may need to update and change these Additional Terms and all documents incorporated by reference, from time to time, without notice to you. You should therefore review these Additional Terms periodically for changes.

2. Description of the Service
Yahoo! Dating allows paid subscribers to get in touch with anyone who has posted an ad on Yahoo! Dating.
3. Communications
As part of your Yahoo! Dating subscription, you agree to receive communications related to the Yahoo! Dating service. Some communications are considered essential to the provision of the service, such as customer service messages or announcements of new functions or features, and you may not opt-out of receiving these communications for the duration of your subscription. For all other communications related to the Yahoo! Dating service, including promotional messages, you will have the choice to opt-in to receive those messages. Your personal information will be processed in accordance with the Yahoo! Privacy Policy which you can refer to at http://privacy.yahoo.com/privacy/au/.
4. Billing
To use the Premium Services, you must have a valid Yahoo! ID and provide your credit card, billing and other information (your "Registration Data"). The credit card that you provide as part of your Registration Data will automatically and immediately be billed the then current fee for the subscription plan you have chosen. All currency references are in AUSTRALIAN DOLLARS ("AUD").

PAYMENT OCCURS ON A PRE-PAY BASIS AND PAYMENT WILL BE AUTOMATICALLY RENEWED AT THE END OF THE RELEVANT TERM. Your billing term will depend upon which subscription plan you choose. For example, if you choose the monthly plan, you will be billed on the date of first registration and thereafter on the same date each month. If you choose the three-month plan, you will be billed on the date of first registration and thereafter on the same date every three months.. If you choose the yearly plan, you will be billed every year on the anniversary date of your Registration.

Please note: If you have received a free offer for a specific number of days, then you will not be charged for the first time until after your free time period has ended. Subsequent billing dates will be on the corresponding reoccurring period of your first billing date. For example, if you purchase a monthly membership on October 15th and you get the first 30 days free, then you will not be charged at all until November 14th (unless you cancel your subscription prior to this date - details of how to cancel are set out under section 7 below). You would be charged again on December 14th and then again on January 14th, and so on until you decide to cancel. If you have signed up for a 7 day free trial subscription and now wish your subscription to change to a 3month or 6monthly period, you must first cancel your current subscription and then resubscribe selecting the longer term.
5. Credit Card Invalidity
Payment occurs on a pre-pay basis and payment will be automatically renewed at the end of the term. Your billing term will depend upon which subscription plan you choose. For example, if you choose the monthly plan, you will be billed every month on the anniversary date of your Registration. If you choose the three-month plan, you will be billed every three months on the anniversary date of your Registration. If you choose the yearly plan, you will be billed every year on the anniversary date of your Registration. Please note: If you have received a free offer for a specific number of days, then you will not be charged for the first time until after your free time period has ended. Subsequent billing dates will be on the anniversary date of your first billing date. For example, if you purchase a monthly membership on October 15th and you get the first 30 days free, then you will not be charged at all until November 14th. (There are 31 days in October.) You would be charged again on December 14th and then again on January 14th, and so on until you decide to cancel.
6. Subscriptions Cancellation
You may only cancel and obtain a refund of your subscription payment if you cancel within 14 days from the date you activate the Premium Services ("Refund Period") and you have not used the Premium Service.

If you cancel more than 14 days from the date that you activate the Premium Services or after you have used the Premium Service, you will not be entitled to a refund however your subscription will remain active for the remainder of the time period for which you have paid. After this period, your subscription will not auto-renew. For example, if you subscribe to a monthly plan, and you cancel after 15 days, you will still have the Service until the end of that 30 day period.
7. How To Cancel Your Subscription
Visit https://ordering.yahoo.com and do the following:

Sign in with your Yahoo! ID and password (if you are not signed in already). To cancel, click on the "Billing Info" link on the home page (2) Next, click the "Cancel" link, then, click on "Cancel My Subscription". (For security purposes, you may be prompted to enter your password in order to proceed with the cancellation.)
8. Modification
Yahoo! expressly reserves the right to immediately modify, suspend or terminate Registrant's account and refuse current or future use of any Yahoo! service, including Premium Services, if Yahoo!, in its sole discretion believes Registrant has: (i) violated or tried to violate the rights of others; or (ii) if we become aware of information indicating a safety concern for you, other Yahoo! Dating users, or the general public, or (iii) acted inconsistently with the spirit or letter of the TOS, the Guidelines or these Additional Terms.
9. Invalidity of Specific Terms
If any provision of these additional terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the such documents remain in full force and effect.
10. Location of Lawsuit
The Yahoo! Terms of Service and the relationship between you and Yahoo! shall be governed by the laws of New South Wales, Australia.
